BotSubscription's Terms of Service

These Terms of Service govern your use of the websites located at https://botsubscription.com, https://docs.botsubscription.com, our Telegram and Discord bots, our web dashboard, hosted checkout pages, and any related services provided by BotSubscription (collectively referred to as the "Platform").

By accessing or using our platform, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from using or accessing our platform.

Account Creation: When you add our Telegram or Discord bot to a group or server, we automatically create a Project and an associated Platform account record for you. This account is tied to your Telegram or Discord user identity and constitutes your contractual relationship with BotSubscription for the purposes of these Terms, the Notices section, billing, and all other provisions herein. If you add the bot or create/use a Project on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.

Default Billing Status & Free Tier: New Projects default to our Progressive fee schedule (free tier by default). The Progressive plan includes a free tier covering your first €85 in monthly Revenue—no invoice is generated and no platform fees are owed until your Revenue exceeds that threshold. To reach that threshold, you must first configure your own payment processor (using your own API keys), create your own subscription plans, and have Subscribers who complete purchases. Simply adding the bot, creating a Project, or configuring settings does not generate any charges—only actual Revenue above the free tier threshold triggers platform fees.

For Projects on the Progressive plan, we will not invoice you or require any payment method unless and until (i) you connect a payment processor and enable monetization, and (ii) your monthly Revenue exceeds €85. For avoidance of doubt, the €85 threshold uses the Revenue definition in the Fees, Payment, and Refunds section (gross receipts, not reduced by refunds or chargebacks). Simply adding the bot or having an account record created does not obligate you to purchase anything.

Other billing plans: Projects on legacy plans, custom agreements, or other billing arrangements are governed by their specific terms and may not include the free tier described above. We will disclose the applicable billing arrangement in-product before any paid features are enabled.

Acceptance of Terms: You accept these Terms by (a) adding our shared bot to your Telegram channels/groups or Discord servers, (b) entering a custom bot token to connect your own bot, (c) enabling billing or publishing a checkout page, or (d) continuing to use the Platform after receiving notice of updated Terms. If you do not agree to these Terms, do not add the bot or use the Platform.

Professional Use & B2B Status: The Platform is intended primarily for professional and commercial use by business entities, sole proprietors, creators, and community managers. By adding our bot, creating or using a Project, accessing the dashboard, or otherwise using the Platform, you confirm that you are acting for purposes relating to your trade, business, craft, or profession. If mandatory consumer protections apply to you under applicable law despite the above representation, nothing in these Terms limits those mandatory rights that cannot be lawfully excluded.

Right of Withdrawal Waiver (EU/UK consumers, where applicable): If you qualify as a consumer under applicable law, your right of withdrawal is handled as follows:

  • Digital content: To the extent the Platform provides digital content not on a tangible medium, we will request your explicit consent to immediate supply and your acknowledgment that you lose the right of withdrawal once supply begins. We will provide confirmation of your consent and acknowledgment on a durable medium (e.g., by email if provided, or via a downloadable confirmation in your dashboard) and record it.
  • Services: To the extent the Platform provides services, you acknowledge that you lose the right of withdrawal once the service is fully performed. If you expressly request that we begin providing services during the withdrawal period, you acknowledge that the right of withdrawal will be lost upon full performance and you will owe a proportionate amount for services already provided if you withdraw before completion.

By enabling paid functionality, publishing a checkout page, or enabling billing, you expressly request that we begin supplying the relevant paid features during the withdrawal period. For digital content (if any) not supplied on a tangible medium, where you give prior express consent and acknowledge the loss of the right, you agree the right of withdrawal is lost once supply begins. For services (including digital services/SaaS), you agree that if you withdraw after requesting immediate performance, you will owe a proportionate amount for services provided up to withdrawal; the right of withdrawal is lost only once the service is fully performed where the legal requirements are met.

This applies including where services are supplied in exchange for personal data where the law treats that as "payment." We strongly recommend providing a valid email address to ensure you receive confirmations and other important notices.

Fallback: If we are unable to collect and record the required consent and acknowledgment for any reason (e.g., technical failure), we will treat the customer as having the default statutory withdrawal right until proper consent is obtained.

Platform Neutrality: BotSubscription is a technical infrastructure provider designed to help creators monetize their communities. We are content-neutral and do not proactively curate, endorse, or police the opinions, advice, or content sold by our users, though we will act on valid legal notices as required by law and may remove content or suspend accounts that violate these Terms.

Regulatory Status: BotSubscription provides software that, when authorized by you, communicates with your chosen payment processor(s) using credentials you provide to create payment objects (e.g., checkout sessions, subscriptions, invoices) and receive event notifications (webhooks). We do not hold, transmit, or take possession of customer funds. All funds flow directly between your Subscribers and your payment processor account; we never have access to or control over those funds. All payment processing is performed by third-party licensed payment processors (e.g., Stripe, PayPal) that you connect and configure.

Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) and have the legal capacity to enter into binding contracts to use this Platform. By using the Platform, you represent and warrant that you meet these requirements.

Minor/Child Data: While you must be 18+ to use this Platform, your Subscribers may include minors depending on your community. You must comply with the minimum age requirements of your hosting platform (e.g., Discord's 13+ requirement, Telegram's age restrictions) and applicable law. You may not knowingly collect personal data from children under 13 (or the applicable age in your jurisdiction) through the Platform, including via custom fields, forms, or any other mechanism. If you become aware that you have collected data from a child under 13, you must delete it promptly and notify us. Violations may result in immediate account termination.

Changes to Terms: We reserve the right to review and amend any of these Terms of Service at our sole discretion. For material changes—including changes to pricing, fees, liability terms, data handling, or termination rights—we will provide at least 14 days' notice in accordance with the Notices section before they take effect. For non-material changes (e.g., clarifications, formatting, typo fixes), we will update this page without prior announcement. Material changes to our Acceptable Use Policy follow the same notice period as material changes to these Terms.

We may suspend your access immediately without notice if you violate these Terms (e.g., fraud, illegal content). For purely business-related discontinuations of the Service, we will provide at least 30 days' notice in accordance with the Notices section to allow you to migrate your data. Continued access during this notice period is strictly conditional upon your account remaining in good standing with all invoices paid. We reserve the right to require prepayment or immediate settlement of outstanding balances during the sunset period.

Relationship of Parties

Roles Defined

  • You (the "Customer," "Bot Owner," or "Admin"): You are the merchant and seller of record for any goods, services, or access sold to your end-users. You set your own prices, define your offerings, and are solely responsible for fulfilling your promises to Subscribers.
  • BotSubscription: We are a software platform only. We provide infrastructure and tools that enable you to manage subscriptions and collect payments. We do not provide the underlying content, access, or services that you sell to your Subscribers.
  • Subscribers (your end-users): The contract for goods, services, or access is strictly between you and your Subscribers. BotSubscription is not a party to that contract.

Payment Flow

BotSubscription does not hold, transmit, or process Subscriber funds directly. All payments flow through third-party payment processors (e.g., Stripe, PayPal) that you configure and control. We are not a bank, money transmitter, or party to the transaction between you and your Subscribers.

Confidentiality

Each party agrees to keep confidential any non-public business information disclosed by the other party in connection with this agreement (e.g., pricing strategies, business plans, technical configurations shared in support tickets). This obligation does not apply to information that: (a) is or becomes publicly available through no fault of the receiving party, (b) was already known to the receiving party, (c) is independently developed without use of confidential information, or (d) must be disclosed by law. This confidentiality obligation survives termination of the agreement for two (2) years.

Your Responsibilities

You are solely responsible for:

  • The legality and quality of the goods, services, or access you provide to Subscribers.
  • Setting prices and communicating terms to your Subscribers.
  • Handling refund requests, chargebacks, and disputes with your Subscribers.
  • Providing customer support to your Subscribers.
  • Complying with all applicable consumer protection laws in your jurisdiction (this refers to your obligations toward your Subscribers, who may be consumers even though you are a business user of our Platform).

Refund Tooling: If we provide tools that allow you (or your bot) to issue refunds to Subscribers, those refunds are executed as your agent and on your instruction using your payment processor credentials. You remain solely responsible for the legality, timing, amount, and Subscriber communications related to any refund—whether initiated manually by you, automatically by your configured rules, or through any other mechanism we provide.

Merchant Disclosures on Hosted Checkouts

Because we host checkout pages on your behalf, you must provide accurate merchant information so Subscribers know who they are transacting with. You agree to:

  • Provide accurate merchant identity: Your legal name or business name, and a contact method (email or support link) must be provided in your project settings.
  • Maintain a refund policy: You must clearly communicate your refund and cancellation policy to Subscribers, either on your checkout page or in your linked terms.
  • Describe what is being sold: Your checkout pages must clearly describe the goods, services, or access being purchased.
  • Service interruption policy: You should disclose what happens if your service becomes unavailable (e.g., bot loses access, you shut down). Even a simple statement (e.g., "If service is interrupted, contact [email] for refunds") helps Subscribers understand their recourse and reduces chargebacks. Subscribers who cannot find you will escalate to payment processors, which affects platform-wide fraud scores.

BotSubscription may display this merchant information on hosted checkout pages and may share it with payment processors, platform providers, or regulatory authorities upon lawful request. You are solely responsible for keeping this information accurate and up to date. Failure to provide required merchant disclosures may result in suspension of your checkout pages.

Platform Fees on Refunded Transactions

If you issue a refund to a Subscriber, BotSubscription reserves the right to retain platform fees already charged on that transaction. We still incur infrastructure and processor-integration costs when a payment is processed—that's what the platform fee covers, regardless of whether you later refund the Subscriber. We may issue credits for platform fees on refunded transactions to be applied toward future platform usage, but we do not provide cash refunds of platform fees. Payment processor fees (e.g., Stripe fees) are subject to the respective processor's refund policies.

Goodwill credits: For duplicate charges, obviously erroneous transactions, or failed payment attempts that were incorrectly recorded as successful, we will credit platform fees upon verification. Contact admin@botsubscription.com with transaction details.

Chargebacks & Disputes

Because you are the merchant of record and BotSubscription does not hold or process Subscriber funds:

  • Chargebacks are your responsibility. Any chargebacks, payment disputes, or reversals initiated by your Subscribers are strictly between you, your payment processor (e.g., Stripe, PayPal), and the Subscriber. BotSubscription is not a party to these disputes and has no ability to contest or reverse chargebacks on your behalf.

  • Fees on charged-back transactions. BotSubscription platform fees charged on transactions that are later reversed via chargeback remain due and are non-refundable. Our services were rendered at the time of the original transaction. Payment processor chargeback fees are governed by your agreement with that processor.

  • Negative balances. If your account accrues a negative balance (e.g., due to platform fees on transactions that were later charged back), you remain liable for that amount. We reserve the right to charge your payment method on file or invoice you directly for any outstanding balance.

  • No liability for processor actions. BotSubscription is not liable if your payment processor freezes funds, holds reserves, terminates your account, or takes other actions due to high chargeback rates or disputes. Managing your chargeback ratio is your responsibility.

Fee Calculation on Adjustments

Platform fees are calculated based on the original successful payment amount at the time of the transaction. Subsequent adjustments do not automatically reduce or reverse fees already charged:

  • Partial refunds: Fees are calculated on the original transaction amount. Partial refunds do not proportionally reduce platform fees.
  • Subscription upgrades/downgrades: Fees apply to each payment event as processed. Prorated adjustments are treated as separate transactions.
  • Coupons applied retroactively: If you retroactively apply a discount, previously charged fees remain due.
  • Processor reversals: If a processor reverses a transaction (chargeback won by Subscriber, fraud reversal, etc.), platform fees on the original transaction remain due unless we determine otherwise.

Our discretion: Notwithstanding the above, BotSubscription reserves the right, acting reasonably, to issue credit notes, void invoices, adjust fees, or provide refunds where we believe it is fair and appropriate to do so. This discretion does not create an obligation or precedent, and we may exercise it differently in different circumstances.

No Responsibility for Subscriber Disputes

BotSubscription shall not be liable for any claims, disputes, or legal actions arising from transactions between you and your Subscribers. If a Subscriber contacts us regarding a dispute, we will direct them to you.

Limitations of Use

By using our platform you warrant on behalf of yourself, your users, and other parties you represent that you will not:

  • modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on BotSubscription's platform;
  • remove any copyright or other proprietary notations from any materials and software on BotSubscription's platform;
  • transfer the materials to another person or “mirror” the materials on any other server;
  • knowingly or negligently use our platform or any of its associated services in a way that abuses or disrupts our networks or any other service BotSubscription provides;
  • use our platform or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
  • use our platform or its associated services in violation of any applicable laws or regulations;
  • use our platform in conjunction with sending unauthorised advertising or spam;
  • harvest, collect or gather user data without the user's consent; or
  • use our platform or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties;
  • make any unauthorized automated use of the platform—automation through our documented APIs, webhooks, and normal bot operation is permitted; however, you may not scrape, crawl, or access the platform through undocumented means, circumvent or attempt to circumvent rate limits, or take any action that imposes or may impose an unreasonable or disproportionately large load on our servers or network infrastructure (see our API Rate Limits for permitted usage);
  • use any Platform feature (including but not limited to broadcasts or automated messages) in a manner that violates anti-spam laws, CAN-SPAM, GDPR consent requirements, or third-party platform policies.

These Terms incorporate the Acceptable Use Policy and other policies by reference. If there is a conflict, these Terms control. The Acceptable Use Policy may impose additional restrictions that apply only to the extent they do not conflict with these Terms. Violations of the Acceptable Use Policy may result in suspension or termination of your account.

API Rate Limits: We may impose rate limits on API access to ensure platform stability and fair usage. Exceeding these limits may result in temporary throttling or suspension of API access. Current rate limits are published in our API Rate Limits documentation.

Content Compatibility & Third-Party Policy Compliance

You acknowledge that BotSubscription functions as a bridge between multiple independent services (e.g., messaging platforms like Telegram or Discord; and payment processors like Stripe, PayPal, or cryptocurrency providers). To use our Platform, your content and business model must comply with the policies of every service you utilize in your specific stack.

1. Hosting Platform Compliance (The "Where"): You must strictly adhere to the Terms of Service, Community Guidelines, and Developer Policies of the platform where your bot or community is hosted.

  • Example: Telegram may allow certain adult content behind sensitive content filters, while Discord requires adult content to be in age-restricted channels and imposes additional restrictions on monetized offerings—you must verify compliance with Discord's Community Guidelines and monetization policies.
  • Your Responsibility: You agree not to use BotSubscription to facilitate the sale of content on a platform where that content is prohibited. If a platform requires you to tag content as "Sensitive" or "18+," or requires specific age-gating, you must comply with those requirements before using our Service.

2. Payment Processor Compliance (The "How"): You must strictly adhere to the Acceptable Use Policy (AUP) of the payment processor you connect to your account.

  • Processor Mismatch: You acknowledge that many processors have restrictive policies for adult/NSFW content, even if the hosting platform (e.g., Telegram) allows it. For example, some processors (including PayPal) restrict sexually oriented goods and services, and some (including Stripe) treat adult content as a restricted category that may require additional review or approval. Processor policies change; you must verify permissibility under your processor's current Acceptable Use Policy.
  • Your Responsibility: You must select a payment method that explicitly permits your specific content category. Using a high-risk-averse processor (like Stripe) to sell high-risk content is a violation of these Terms.
  • Processor Policy Acknowledgment: When you connect a payment processor, we may require you to confirm that you have reviewed that processor's Acceptable Use Policy and that your content is permitted. We may provide general guidance about processor restrictions, but you are solely responsible for confirming permissibility under your processor's specific policies. This acknowledgment will be logged and may be used as evidence in any dispute.

3. The "Intersection of Permissions" Rule: If either your Hosting Platform or your Payment Processor prohibits your content, you are prohibited from using BotSubscription for that specific purpose.

4. Age-Restricted Content & Verification: If you sell age-restricted content (including adult, NSFW, gambling, or other age-gated material), you warrant that you maintain a mechanism to verify the age of your Subscribers in compliance with applicable age-gating and age-assurance laws, as well as platform requirements, in the jurisdictions where you operate and where your Subscribers are located. BotSubscription does not provide age verification services, and you are solely responsible for implementing and maintaining compliant age-gating. Failure to properly age-gate your content may constitute a violation of these Terms.

Consequences of Violation: If we receive notice that you have violated the policies of a third-party provider (e.g., your bot is banned by a platform for policy violations, or your funds are frozen by a processor for AUP violations), BotSubscription reserves the right to immediately suspend your account to protect our technical infrastructure and reputation. We bear no liability for funds frozen or accounts banned by third parties due to your non-compliance. You agree to indemnify BotSubscription for any fines, penalties, or costs passed on to us by third-party providers resulting from your violations.

Regulatory & Financial Compliance

You are solely responsible for ensuring your use of the Platform complies with all applicable laws and regulations in your jurisdiction, including but not limited to financial regulations, anti-money laundering (AML) laws, and sanctions requirements.

Prohibited activities include:

  • Money laundering, terrorist financing, or sanctions evasion
  • Operating unlicensed money transmission or payment services where a license is required
  • Facilitating illegal gambling or other regulated activities without appropriate authorization
  • Using the Platform to circumvent legal obligations that apply to you (e.g., if your jurisdiction requires you to perform KYC on your customers, you may not use the Platform to avoid that obligation)
  • Using the Platform if you are located in, organized under the laws of, or a resident of any country subject to comprehensive trade sanctions (e.g., U.S. OFAC, EU, or UN sanctions lists)

Sanctions Warranty: By using the Platform, you represent and warrant that: (a) to the best of your knowledge, you are not located in a comprehensively sanctioned jurisdiction and are not a Specially Designated National, blocked person, or otherwise restricted under applicable sanctions laws; and (b) you will not knowingly facilitate transactions with comprehensively sanctioned jurisdictions or blocked persons, and will take reasonable steps appropriate to your business model to prevent such transactions (e.g., geo-blocking sanctioned regions where practical, reviewing suspicious activity). We reserve the right to request additional compliance documentation from accounts we deem high-risk, and to comply with lawful requests and legal obligations.

Payment processor options: We integrate with various third-party payment processors, including traditional providers (e.g., Stripe, PayPal) and cryptocurrency processors (e.g., NowPayments). Some processors may not require KYC for certain transaction types or amounts—this is permitted where lawful. However, you remain responsible for your own legal compliance, regardless of which processor you choose. The availability of a no-KYC payment option does not exempt you from regulations that apply to your business in your jurisdiction.

Cryptocurrency compliance: If you use cryptocurrency payment processors, you are solely responsible for complying with all applicable laws regarding digital assets, including tax reporting and any applicable financial regulations in your jurisdiction. BotSubscription does not provide cryptocurrency custody and is not a money transmitter.

Cryptocurrency & Payment Processor Configuration: You are solely responsible for the accuracy of any API keys, wallet addresses, and destination credentials ("Configuration Data") you provide to the Platform or your third-party payment processors (e.g., NowPayments).

Nature of Crypto Checkouts: You acknowledge that for many cryptocurrency processors, the address displayed to the Subscriber on a checkout page is a temporary deposit address generated by the processor, not your personal settlement wallet. BotSubscription displays this address exactly as returned by the processor's API.

Duty to Verify Settlement: Because we do not control the generation of these addresses, you agree to:

  • Verify your Processor Configuration: Ensure your settlement wallet is correctly configured directly within your payment processor's dashboard (e.g., inside your NowPayments account).
  • Perform End-to-End Testing: You must perform a real, low-value test transaction to ensure that funds sent by a Subscriber are successfully received by the processor and correctly settled into your destination wallet.
  • Monitor Integration: Regularly audit your checkout flow to ensure the processor is returning valid payment data.

Limitation of Liability: BotSubscription acts solely as a user interface for your chosen processor. We are not liable for lost funds resulting from: (a) incorrect Configuration Data provided by you to us or the processor; (b) using the wrong network or currency settings (e.g., sending USDT on the wrong chain); (c) a compromise of your payment processor account (e.g., if an attacker changes the settlement address inside NowPayments); or (d) discrepancies between the address generated by the processor and the address displayed on our Platform, unless caused by our gross negligence.

Exact Match Warranty: BotSubscription passes wallet addresses and Configuration Data exactly as you enter them—we do not trim, modify, or validate addresses. We are not responsible for funds lost due to incorrect destination wallet addresses entered by you via our dashboard, bots, hosted checkout pages, or any other interface. We are also not liable for funds sent to a processor-generated address after the transaction timer has expired (a common issue with cryptocurrency payments where the deposit address is only valid for a limited time).

Crypto Settlement & Refunds: Cryptocurrency values fluctuate. Refunds for cryptocurrency transactions, if offered by you, are calculated based on the fiat value at the time of the original transaction—not the current market value. BotSubscription is not liable for exchange rate fluctuations between the time of payment and the time of refund. You are solely responsible for determining your refund policy and communicating it clearly to your Subscribers.

Payment processor compliance: You must comply with the terms and policies of any payment processor you use. BotSubscription does not control these processors and is not responsible for their compliance requirements, fees, or actions.

Duplicate Events & Idempotency: Payment processors may occasionally send duplicate webhook events or experience race conditions. We use commercially reasonable efforts to deduplicate events and prevent duplicate charges or access grants on the platform side. However, if platform-side duplication occurs despite these efforts, we will correct it upon notification. You remain responsible for issuing any necessary refunds to Subscribers and for implementing your own idempotency checks if you build custom integrations using our API.

Payment Token Non-Portability: You acknowledge that payment tokens (e.g., credit card tokens, subscription IDs) are not portable between different payment processors. If you switch processors (e.g., from Stripe to PayPal, or from PayPal to a cryptocurrency processor), your existing Subscribers may need to re-subscribe using the new payment method. BotSubscription cannot migrate billing relationships between processors, and we are not liable for subscriber loss or disruption resulting from processor changes.

No regulatory advice: BotSubscription does not provide legal, financial, or regulatory advice. If you are unsure whether your intended use complies with applicable laws, consult a qualified professional before using the Platform.

Geographic Restrictions: We reserve the right, acting reasonably, to restrict or deny access to the Platform in certain countries or jurisdictions for regulatory, risk, or business reasons.

High-Risk Use & Enhanced Due Diligence: Certain use cases, payment methods, or project characteristics may trigger enhanced scrutiny. This includes, but is not limited to: adult/NSFW content, gambling or gaming, cryptocurrency payment rails (especially no-KYC processors), high transaction volumes, elevated chargeback rates, or potential sanctions exposure. In such cases, we may:

  • Request additional information about you or your business
  • Impose transaction limits or require reserves
  • Restrict access to certain payment methods or features
  • Require you to use a specific processor category (e.g., high-risk-friendly)
  • Suspend or terminate your account if satisfactory information is not provided

Using low-KYC or no-KYC payment rails does not exempt you from AML, sanctions, or other legal obligations—it increases your compliance burden, not ours.

We reserve the right to suspend or terminate accounts that we reasonably believe are being used for prohibited activities or that expose BotSubscription to regulatory risk.

Intellectual Property

Access License: BotSubscription grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform for your internal business purposes in accordance with these Terms. You acknowledge that the Platform, including its code, design, and architecture, is the proprietary property of BotSubscription.

Marketing & Publicity (Opt-Out): Unless you opt out, BotSubscription may identify you as a customer and reference your bot's name and general use case in marketing materials (e.g., website case studies, pitch decks). We will not use your logo without separate permission. To opt out entirely, email admin@botsubscription.com with subject "Marketing Opt-Out" and we will remove any existing references and exclude you from future marketing.

User-Generated Content

You retain your intellectual property ownership rights over content you submit to us. We will never claim ownership of your content, but we require a license to use it for the functioning of the Service.

When you use our platform to transmit content, you grant to us a non-exclusive, royalty-free, worldwide license to use, distribute, and display your content solely as necessary to provide the Service, consistent with your privacy preferences and our Privacy Policy.

AI-Generated Content: You are solely responsible for all content transmitted by your bot, including automated or AI-generated responses. This applies whether you use third-party AI services (e.g., ChatGPT, Claude, or custom models) or BotSubscription's built-in AI features (e.g., AI support agent). While we may provide AI tools and infrastructure, you control the behavior of these systems through your instructions, core directive (system prompt), knowledge base, and configuration. You remain fully liable for any outputs these systems produce, including but not limited to harmful, defamatory, misleading, or illegal content. BotSubscription does not review, moderate, or control AI outputs generated based on your configuration.

No Duty to Monitor: We are a neutral infrastructure provider. We do not proactively pre-screen, endorse, or monitor the content, opinions, or advice sold by Bot Owners. However, we act on complete notices submitted through our reporting mechanisms and may remove or disable hosted content that violates our Acceptable Use Policy or applicable law. Content moderation decisions may involve automated detection and/or human review depending on the context and urgency. We disclaim all liability for the conduct or content of any Bot Owner.

API Access & Data Security

Payment Data & PCI Compliance

We do not store full payment card details. All payment transactions occur directly between you, your Subscribers, and your chosen third-party payment processors (e.g., Stripe, PayPal). BotSubscription never receives, transmits, or stores full credit card numbers, CVVs, or other sensitive payment credentials.

We may receive and store tokenized payment references from your payment processors, along with limited metadata (e.g., last four digits, expiration date, card brand) for display and recurring billing purposes. These tokens are issued by your payment processor and cannot be used to recover full card details.

Nature of Technical Services: BotSubscription acts solely as a technical service provider offering subscription automation and infrastructure that passes payment events to third-party processors. We do not at any point enter into possession of funds transferred between Subscribers and Bot Owners, nor do we provide payment services, money transmission, or banking services. All flow of funds occurs directly between the Subscriber and the Bot Owner via the selected third-party payment processor.

PCI Scope: Our Platform is designed so that we do not intentionally store, process, or transmit cardholder data (CHD). Because we use tokenization and hosted checkout pages provided by PCI-compliant processors, your PCI DSS scope is significantly reduced. However, tokenization does not eliminate your PCI DSS obligations entirely. You acknowledge that you remain responsible for ensuring your own business practices comply with applicable PCI standards (e.g., not collecting card numbers via chat, screenshots, or other insecure channels). If you or your Subscribers inadvertently submit CHD to our Platform (e.g., in support tickets or description fields), you acknowledge that this is a violation of these Terms and we will delete such data upon discovery.

Your compliance obligations: All payments through our Platform are processed via integrated PCI-compliant providers (Stripe, PayPal, etc.), which handle card data entirely on their end. You should never collect or handle payment card data directly—if you do so outside of our Platform (e.g., asking customers for card numbers via chat), you are solely responsible for your own PCI DSS compliance.

Credential Security & Deletion

Our Commitment: All API credentials you provide are stored using industry-standard encryption. Upon termination of your account, we will disable access and purge your API credentials from our active systems within 7 days. We have no interest in retaining access to your accounts after you leave.

Defense in Depth (Your Responsibility): As a security best practice—and consistent with guidance from Stripe, PayPal, and other payment processors—you should also revoke BotSubscription's API access and webhooks directly at your payment processor dashboard when you stop using our Service. This ensures your credentials are invalidated at the source, providing an additional layer of protection regardless of any system's state.

Liability: We are not responsible for post-termination actions resulting from your failure to revoke credentials at the processor level, to the maximum extent permitted by law. This does not limit liability that cannot be limited under applicable law. Prompt revocation remains the most reliable way to secure your accounts.

Account Security

You are solely responsible for the security of your account, including your login credentials, API keys, and any access granted to team members or third parties. BotSubscription is not liable for any loss, damage, or unauthorized actions resulting from:

  • Compromised credentials or API keys.
  • Actions taken by your team members, employees, or contractors.
  • Unauthorized access due to your failure to implement reasonable security practices.

Setup Threads & Sensitive Data: Setup threads and bot configuration channels may be visible to server moderators or admins with elevated permissions. Do not paste API keys, tokens, passwords, or other secrets in chat threads—use secure configuration methods (e.g., the dashboard or direct bot commands in private).

Credential-Based Authorization: BotSubscription treats any action performed using your valid login credentials, API keys, or access tokens as an action authorized by you. We do not verify the identity of individuals using valid credentials, nor do we distinguish between actions taken by the account owner versus delegated users. If someone with access to your credentials changes your payout address, deletes your Project, or takes other harmful actions, you bear full responsibility.

If you suspect unauthorized access to your account, you must notify us immediately and revoke any compromised credentials.

Loss of Access to Third-Party Platforms

If you lose access to your Telegram or Discord account (e.g., due to hacking, account ban, or loss of credentials), you remain responsible for all fees incurred until you disconnect the integration within the BotSubscription dashboard. If you cannot access the dashboard, you must contact us and complete our identity verification process before we can disable billing on your behalf. BotSubscription is not liable for payments collected or access granted while your third-party account was compromised, provided our Platform was functioning as configured.

Automatic Cessation of BotSubscription-Initiated Charges: If your bot or integration token is invalidated (e.g., your bot is banned by Telegram or Discord), we may, at our sole discretion, pause or cease initiating new charges through BotSubscription to protect the fraud rating and reputation of our platform. This is a right, not an obligation.

Processor-Side Recurring Subscriptions: You acknowledge that BotSubscription cannot stop automatic recurring subscriptions that are managed directly by your payment processor (e.g., Stripe, PayPal). If your bot is banned but your Subscribers have active recurring subscriptions at the processor level, those charges may continue independently until you cancel them directly in your processor's dashboard. You are solely responsible for managing processor-side subscriptions and indemnify BotSubscription for any Subscriber claims arising from continued billing after your bot becomes inaccessible.

Configuration Risk

You are solely responsible for correctly configuring all integrations, settings, and mappings within the Platform. BotSubscription is not liable for service failures, access issues, or lost revenue resulting from misconfiguration, including but not limited to:

  • Webhook misrouting: Incorrect webhook URLs or endpoints that prevent payment events from being processed.
  • Product/plan mapping errors: Wrong product IDs, pricing, or plan configurations that result in incorrect charges or access grants.
  • Discord role/channel mapping: Incorrect role assignments or channel permissions that grant access to the wrong users or fail to grant access to paying Subscribers.
  • Telegram admin rights: Failure to maintain bot admin rights in your channel/group, preventing the bot from adding or removing members.
  • API credential expiration: Expired or revoked API keys that disrupt integrations.

Your duty: Test your configuration thoroughly before going live. Regularly audit your integrations, especially after making changes. BotSubscription displays and acts on the configuration you provide—we do not validate business logic or catch configuration errors on your behalf.

"Paid but didn't get access" scenarios: If a Subscriber's payment succeeds but access is not granted:

  • Due to your misconfiguration (e.g., Discord role hierarchy preventing the bot from assigning roles, Telegram bot lacking admin rights, incorrect plan mapping): You are responsible for resolving the issue and handling any refund requests from the Subscriber.
  • Due to a platform-side failure (e.g., a bug in BotSubscription's access-granting logic): We will assist with logs and remediation. However, refunds to Subscribers remain your responsibility as the merchant of record. We may, at our discretion, credit platform fees on affected transactions.

In all cases, you are responsible for Subscriber communications and satisfaction. We recommend publishing a support contact and response-time expectation on your checkout page.

Pending payments: Access is granted only when your payment processor confirms the payment as complete (e.g., "succeeded" or "captured" status). Payments in "pending," "requires_action," or "under review" states do not trigger access grants. This is normal processor behavior—PayPal may hold payments for fraud review, Stripe may require additional authentication, and cryptocurrency processors may wait for blockchain confirmations. If a Subscriber complains that they "paid" but haven't received access, verify the payment status in your processor dashboard before escalating. We cannot grant access for unconfirmed payments.

Account Ownership & Sharing

Each account has a single registered owner who is solely responsible for all activity under that account. If you share account access with business partners, employees, or other parties, you remain fully responsible for their actions and any resulting charges or violations.

BotSubscription will not mediate ownership disputes. If multiple parties claim ownership of an account, we may, at our sole discretion:

  • Freeze the account until the parties provide evidence of a resolution (e.g., a court order or signed agreement).
  • Continue to recognize only the originally registered account holder.
  • Require the disputing parties to resolve the matter independently before we take any action.

We are not liable for any losses resulting from shared account access or internal disputes among business partners.

Multiple Bots & Account Consolidation

No Limits on Bots: Unlike some third-party platforms (e.g., Telegram) which may limit the number of bots a single user can create, BotSubscription allows you to connect and manage an unlimited number of bots under a single BotSubscription account.

Account Consolidation: You are expected to manage all your projects under a single BotSubscription account. This allows you to:

  • Centralize your dashboard, revenue reporting, and subscriber management.
  • Manage multiple brands or communities without logging in and out.

Prohibition on Fee Evasion (Smurfing): You agree not to create multiple BotSubscription accounts for the purpose of splitting revenue to evade platform fees, bypass Free Tier limits, or manipulate pricing tiers.

Right to Aggregate: If we reasonably determine that multiple accounts are owned or controlled by the same entity and are being used to circumvent fee thresholds, we reserve the right to treat them as a single account for billing purposes. We may aggregate the revenue across all linked accounts to calculate the correct Platform Fees and invoice you for the difference.

Data Retention & Deletion

Your Data

You may request export or deletion of your account data at any time by contacting our support team.

Data Export Details:

  • Format: Exports are provided in commonly used, machine-readable formats (typically JSON or CSV).
  • Timeline: Standard export requests are processed within 14 days. Legally required exports (e.g., GDPR data portability) are processed within legally mandated timelines.
  • Availability: Export files remain available for download for 30 days after generation. After that, you must submit a new request.
  • Cost: Standard exports covering your account data and recent subscriber records are free. For unusually large or complex requests (e.g., full historical logs spanning years, custom formats), we may charge reasonable fees for the additional processing time, disclosed before work begins.

Upon receiving a verified deletion request, we will:

  • Delete or anonymize your personal account information from active systems within 30 days
  • Purge API credentials and webhook configurations within 7 days
  • Retain billing records and transaction logs as required by applicable tax and accounting laws (typically 7 years)

Complete deletion across all systems (including secondary systems and backups) is finalized within 90 days of the verified request. Backup copies are encrypted and access-restricted; they are retained solely for disaster recovery purposes and will not be used to restore deleted data except at your request.

Subscriber Data

Data about your Subscribers (e.g., subscription status, Telegram/Discord user IDs) is stored to provide the Service. You are responsible for honoring any data deletion requests from your Subscribers as required by applicable privacy laws (e.g., GDPR) and platform policies.

If you need assistance fulfilling a Subscriber's deletion request, contact our support team. We will process such requests in accordance with our Privacy Policy and any applicable Data Processing Agreement.

Data Processing Addendum (DPA)

This section constitutes the Data Processing Agreement between you and BotSubscription for the purposes of GDPR Article 28, UK GDPR, CCPA/CPRA, and equivalent data protection laws. By using the Platform, you accept these data processing terms.

You are the Data Controller (or "Business" under CCPA) and BotSubscription is a Data Processor (or "Service Provider" under CCPA) with respect to any personal data of your Subscribers that we process on your behalf. We do not sell personal information.

Data role clarification: BotSubscription acts as an independent Data Controller for: (a) your account registration and profile data, (b) billing and payment records, (c) security and fraud prevention logs, and (d) platform analytics and service improvement data. For these categories, we process data for our own legitimate business purposes and are not acting on your instructions. You cannot use this DPA to demand deletion of data we are entitled to retain as controller (e.g., security logs, tax records). See our Privacy Policy for details on how we process data as controller.

Our obligations as processor:

  • We process Subscriber data only on your documented instructions (i.e., to provide the Service).
  • We implement appropriate technical and organizational security measures, including encryption of data at rest and in transit, access controls, and regular security assessments.
  • We assist you in responding to data subject requests (access, deletion, portability) upon request.
  • We delete or return personal data upon termination of the Service, subject to legal retention requirements.
  • We only engage sub-processors that provide appropriate data protection and security guarantees and that are bound by written terms requiring protections no less protective than those in this DPA, as required by applicable data protection law.
  • Confidentiality: We ensure that all personnel authorized to process Subscriber data have committed themselves to confidentiality or are under an appropriate statutory obligation of confidentiality.
  • Assistance: We will provide assistance with DPIAs and prior consultations with supervisory authorities only to the extent required by applicable data protection law and only to the extent that the relevant information is available to us. We may charge reasonable fees for requests that go beyond standard support.
  • Audits: Upon written request, we will make available information reasonably necessary to demonstrate compliance with Article 28 obligations. Audits are documentation-first and remote by default. We will satisfy audit requests by providing relevant documentation, which may include: security policies and procedures, sub-processor lists and DPAs, incident response processes, and (where available) independent third-party audit reports (e.g., SOC 2, ISO 27001). Audit requests are limited to no more than once per 12 months unless required by a competent supervisory authority, must be scoped to data and systems relevant to the requesting customer's account, and are subject to reasonable notice and confidentiality obligations. Where an on-site inspection is reasonably necessary to satisfy Article 28 obligations and cannot be satisfied through documentation and remote review, we will allow an on-site inspection subject to reasonable notice, strict confidentiality, security requirements, and scope limited to systems relevant to the requesting customer's data. The customer bears its own audit costs and must avoid disruption to our operations. Penetration testing or direct access to systems requires a separate written agreement.

Sub-processors: A current list of our sub-processors is published at Sub-Processors List. We will notify you of any intended changes to sub-processors at least 30 days before the change takes effect, giving you the opportunity to object. Notifications will be sent in accordance with the Notices section, including public channels given the platform-wide nature of such changes. If you object to a new sub-processor and we cannot reach a mutually acceptable resolution, you may terminate the Service before the sub-processor is engaged.

International transfers: If Subscriber data is transferred outside the EEA/UK, we rely on appropriate safeguards such as Standard Contractual Clauses (SCCs) or adequacy decisions. Details are available upon request.

Security incident notification: In the event of a personal data breach affecting Subscriber data, we will notify you without undue delay, and where feasible within 72 hours of becoming aware, providing sufficient information to enable you to meet your own notification obligations. If a security incident is caused by your actions or negligence, we will provide reasonable assistance, but we reserve the right to charge reasonable professional service fees for non-standard investigation or notification support requested by you that exceeds our statutory obligations.

Your obligations as controller:

  • You must have a valid legal basis (e.g., consent, contractual necessity) for collecting and processing Subscriber data.
  • You are responsible for providing privacy notices to your Subscribers and honoring their data rights.
  • You must notify us promptly if you receive a data subject request that requires our assistance.

Separately executed copy: If you require a separately executed copy of this DPA, we may provide one to verified authorized representatives of active customers (e.g., via e-signature). We may refuse requests that are not tied to an active customer relationship or where we cannot verify the requester's authority to act on behalf of the customer.

You remain responsible for instructing us on deletion requests you receive from your end-users. If you cease operations or your bot is terminated, you must notify us so we can process appropriate data deletion in accordance with platform requirements.

Service Availability

We explicitly do not guarantee 100% uptime. We will use commercially reasonable efforts to maintain Platform availability.

Exclusions: Availability calculations exclude the following:

  • Scheduled maintenance (announced in advance where practical)
  • Outages or degradation of third-party services (Telegram, Discord, Stripe, PayPal, hosting providers, etc.)
  • Force majeure events (natural disasters, war, government actions, pandemics, internet backbone failures, or other circumstances beyond our reasonable control)
  • Issues caused by your actions, configurations, or third-party integrations you control

In the event of significant downtime, we will endeavor to communicate clearly via our official status channels (e.g., Discord, Telegram). This availability target does not constitute a service level agreement (SLA) and does not entitle you to credits, refunds, or compensation for downtime.

Beta Services: From time to time, we may invite you to try "Beta", "Pilot", or "Early Access" features. You acknowledge that these features are experimental, may contain bugs, and are provided "as is" with no warranty or service level commitment. We may discontinue Beta features at any time without notice. You use Beta features at your own risk. We are not liable for any data loss, data corruption, service instability, unintended actions (e.g., duplicate messages), or reputational harm arising from your use of Beta Services. If a Beta feature causes demonstrably incorrect charges to Subscribers, we will work with you in good faith to identify and assist with correcting erroneous transactions, though you remain responsible for managing refunds with your payment processor.

Service Changes & Deprecations: We may modify, deprecate, or discontinue Platform features at any time, particularly in response to changes in third-party platform APIs, policies, or terms (e.g., Telegram, Discord, Stripe, PayPal). If a third-party platform changes its API, imposes new restrictions, or modifies its policies, we may need to adjust or remove affected functionality accordingly. We will make reasonable efforts to notify you of material changes, but we are not liable for service modifications required by third-party platform changes. No SLA credits or compensation are owed for such changes unless explicitly provided in a separate written agreement.

Payment Processor Deprecation: If we discontinue support for a payment processor, we will provide at least 30 days' notice to allow you to migrate to an alternative processor. This notice requirement does not apply if the processor itself terminates our integration or becomes unavailable due to circumstances beyond our control.

Liability

Our platform is provided on an 'as is' basis. To the extent permitted by law, BotSubscription makes no warranties, expressed or implied, and hereby disclaims all other warranties including implied warranties or conditions of merchantability or fitness for a particular purpose.

In no event shall BotSubscription be liable for any consequential loss (including loss of profit, loss of data, or loss of business reputation) suffered or incurred by you or any third party arising from the use or inability to use BotSubscription's platform.

Limitation of Direct Damages

To the maximum extent permitted by applicable law, BotSubscription's total cumulative liability for any and all claims arising out of or related to these Terms or your use of the Platform—whether in contract, tort (including negligence), or otherwise—shall not exceed the total fees you paid to BotSubscription during the three (3) months immediately preceding the event giving rise to the claim.

If you have not paid any fees to BotSubscription, our maximum liability shall not exceed fifty euros (€50).

Exceptions to Liability Limitations

The limitations and exclusions of liability in this section do not apply to:

  • Liability arising from BotSubscription's fraud, gross negligence, or intentional misconduct.
  • Any liability that cannot be excluded or limited under applicable law.

Third-Party Platform Dependency

You acknowledge that the Service relies on the continued availability of third-party platforms, including but not limited to Telegram and Discord APIs. BotSubscription is not liable if your access to these platforms is suspended, restricted, or terminated by the respective platform owners for any reason, including violations of their terms of service.

Such a suspension or ban by a third-party platform does not constitute a failure of our Service and does not entitle you to a refund. You are solely responsible for ensuring your use of Telegram, Discord, and other integrated platforms complies with their respective terms and policies.

Payment Provider Account Status

You are solely responsible for maintaining your payment processor accounts (e.g., Stripe, PayPal) in good standing. BotSubscription is not liable if your payment provider:

  • Freezes, holds, or seizes your funds
  • Suspends or terminates your account
  • Imposes reserves, delays payouts, or limits your processing volume
  • Takes any other action due to your chargeback rates, risk profile, business type, or alleged policy violations

Such actions by payment providers do not constitute a failure of BotSubscription's Service. If your payment provider account is suspended or terminated, your bot's payment functionality may cease to work until you resolve the issue with your provider or configure an alternative processor.

Platform Policy Compliance

You agree to comply with all applicable terms of service, developer policies, and community guidelines of Telegram, Discord, and any other third-party platforms you use in conjunction with our Service. This includes, but is not limited to:

  • Privacy policy requirement: You must maintain and link to a privacy policy for your bot/service as required by applicable law and/or platform policies. We provide a default template for convenience, but you are responsible for ensuring your privacy disclosures are accurate and legally compliant.
  • Data deletion obligations: You must promptly process end-user data deletion requests as required by platform policies (e.g., Telegram requires deletion "without undue delay"). If you need our assistance as your data processor, you must instruct us promptly.
  • Data retention limits: You may not retain end-user data longer than necessary for your stated purpose. Indefinite retention of user data without lawful basis may violate platform terms.
  • Lawful use: Not using the Platform to facilitate activities prohibited by Telegram, Discord, or applicable law.
  • Bot/app guidelines: Following all bot developer terms and API usage policies.
  • Data usage prohibitions: You may not scrape, data-mine, harvest, sell, or transfer end-user data from Telegram, Discord, or any other integrated platform, and you may only use such data as necessary to operate your bot/project and provide the services your Subscribers requested. Violations may result in immediate termination.
  • Incident notification: If you become aware of any unauthorized access to platform API data (e.g., a data breach affecting Discord user data), you must notify both us and the affected platform promptly, as required by Discord's Developer Policy and similar platform requirements.
  • AI/ML restrictions: You may not use message content or other data obtained via Telegram or Discord APIs to train machine learning or AI models unless the respective platform expressly permits it. If you use any AI features (e.g., AI support agents, knowledge bases) in connection with your bot, you are solely responsible for ensuring your AI configuration complies with the applicable platform's developer policies.

Cooperation with platform requests: If a platform (Telegram, Discord, etc.) requests or requires deletion, retention, or other compliance action regarding your account or data, you must cooperate promptly. You authorize us to take steps necessary to maintain platform compliance, including disabling features, checkout pages, or bot functionality, without prior notice if urgency requires.

Enforcement: Violations of third-party platform policies may result in immediate suspension or termination of your BotSubscription account. We take platform compliance seriously because violations by individual customers can jeopardize our API access and affect all customers. If we receive notice from Telegram, Discord, or another platform that your data handling practices violate their policies, we may suspend your account pending resolution.

No Affiliation Disclaimer

BotSubscription is not affiliated with, endorsed by, or sponsored by Telegram, Discord, Stripe, PayPal, or any other third-party platform or payment processor. All product names, logos, and brands are property of their respective owners. References to these services are for identification purposes only and do not imply any partnership or endorsement.

Fees, Payment, and Refunds

Pricing

We reserve the right to adjust pricing. However, we will provide at least 30 days' notice before any price increase applies to your existing subscription. Price changes will not affect your current billing cycle—only subsequent renewals. If you do not agree to the price change, you may cancel your subscription before the new price takes effect.

Revenue Definition (Fee Calculation)

For the purpose of calculating platform fees (including free tier thresholds), "Revenue" means the gross amount of all successful payments processed through the Platform on your behalf during the billing period. Revenue is measured at the time a payment is successfully processed; later refunds, chargebacks, reversals, or retroactive discounts do not reduce Revenue for fee calculation purposes unless we explicitly agree otherwise. This includes:

  • All subscription payments, one-time purchases, and tips received from Subscribers
  • Payments in any currency, converted to EUR using the European Central Bank (ECB) reference rate (or the nearest available business-day rate) we record for the transaction date. Our recorded conversion is final for invoicing purposes; if you believe there is an error, you must raise a dispute within 14 days of invoice issuance

Revenue does NOT deduct:

  • Refunds you later issue (fees on refunded transactions may be retained per the "Platform Fees on Refunded Transactions" section)
  • Chargebacks (fees remain due per the "Chargebacks & Disputes" section)
  • Payment processor fees, network fees, miner fees, gas fees, or settlement deductions (these are separate from your gross revenue)

Revenue IS based on the actual amount charged. If you offer coupons or discounts to your Subscribers, only the discounted amount actually paid is counted as Revenue.

Excluded from Revenue:

  • Failed or declined payment attempts
  • Payments that were fully refunded before our billing cycle closes (at our discretion)
  • Test transactions

If you believe there is an error in the revenue calculation, contact our support team within 14 days of receiving your invoice (or longer if you can demonstrate reasonable cause for delayed discovery). We will review the data and correct any verified errors.

Taxes

Our fees exclude taxes. All fees quoted by BotSubscription are exclusive of VAT, sales tax, withholding tax, and any other applicable taxes unless explicitly stated otherwise. If we are required to collect VAT or other taxes on our fees, these will be added to your invoice. For business customers within the EU (excluding Bulgaria) who provide a valid VAT ID, we will apply the Reverse Charge mechanism (0% VAT). We may validate your VAT ID via VIES (VAT Information Exchange System) or equivalent services. You are responsible for providing accurate VAT details; if your VAT ID is invalid, expired, or cannot be verified, standard VAT rates will apply and you will not be entitled to a refund of VAT already charged.

Your tax obligations. You are solely responsible for determining and fulfilling your own tax obligations, including:

  • Collecting and remitting VAT, sales tax, or other taxes on payments you receive from your Subscribers
  • Issuing appropriate invoices or receipts to your Subscribers
  • Reporting income and paying applicable taxes in your jurisdiction
  • Complying with any tax registration requirements (e.g., VAT registration thresholds)

BotSubscription does not provide tax advice and is not responsible for your tax compliance. Consult a qualified tax professional for guidance on your specific situation.

Refunds (Post-Paid Services)

For our standard post-paid services (where you are billed after usage), payments are non-refundable. You are paying for time and resources you have already utilized.

Refunds (Pre-Paid Balance)

If you have purchased pre-paid credits or topped up a balance:

  • Funds that have already been consumed or applied to settle bills are non-refundable.
  • Unused balance may be eligible for a refund upon request made within 30 days of the deposit, subject to a deduction of any applicable transaction fees. Balances older than 30 days are non-refundable but remain available as platform credit for use on the Platform. We may, at our sole discretion, extend the 30-day refund window in cases of demonstrated hardship or clear non-use of the Platform. Refunds will be processed to the original payment method used for the deposit. If the original payment method is no longer available (e.g., expired card, closed account), we may, at our sole discretion, issue platform credit or process the refund via an alternative method. We may require identity verification or refuse alternate refund methods to prevent fraud and comply with anti-money laundering obligations.
  • We reserve the right to deny refunds of pre-paid balances if your account is terminated due to a violation of these Terms (e.g., fraud).

Late Payments & Non-Payment

Payment terms: Invoices are due upon receipt unless otherwise specified. If your payment method on file fails, we will notify you and provide a grace period to resolve the issue. The length of the grace period is at our discretion and may vary.

Consequences of non-payment:

  • Suspension: If payment is not received within the grace period, we may immediately suspend your account and disable your bot's functionality until the balance is paid.
  • Late fees: If your balance remains unpaid after the grace period expires, we may apply a late fee. Late fees will not exceed 10% of the overdue amount or the maximum rate permitted by law, whichever is lower. No late fees will be charged during the grace period.
  • Collection costs: If we engage a collection agency or legal counsel to recover unpaid amounts, you agree to pay all reasonable collection costs and legal fees incurred.

Right to offset: We may offset any unpaid invoices or amounts owed to us against any prepaid balance or credits in your account.

Reinstatement: Reinstatement of suspended accounts is subject to payment of all outstanding amounts (including any applicable late fees). Reinstatement is only possible if your account data has not been deleted pursuant to our data retention policies.

Cancellation

You can cancel your subscription at any time by deleting your Project (or disconnecting the integration). Your cancellation will take effect immediately. Because our service is post-paid, deleting your Project triggers a final settlement event. You remain liable for any accrued charges and unbilled usage incurred up to the moment of deletion. Your final invoice will be generated within 48 hours of deletion and charged to your payment method on file.

Inactive Account Data Retention

We reserve the right to delete account data (including configurations, subscriber lists, and stored content) for accounts that have been: (a) suspended for non-payment for more than 180 days; or (b) inactive (no logins, no active subscribers, and no payment processing) for more than 12 months. Where we have a working email address on file, we will normally send at least one reminder before deletion; otherwise we will use reasonable efforts via available channels. This policy exists to manage storage resources and does not affect accounts in good standing.

Force Majeure

Neither party shall be liable for any failure or delay in performing their obligations under these Terms where such failure or delay results from force majeure events beyond that party's reasonable control, including but not limited to: natural disasters, war, terrorism, riots, government actions, pandemics, labor disputes, internet or telecommunications failures, cybersecurity incidents (including ransomware attacks and denial of service attacks), power outages, or failures of third-party services (including Telegram, Discord, Stripe, PayPal, or hosting providers). This clause does not apply to cybersecurity incidents attributable to that party's failure to implement reasonable security measures.

During a force majeure event, affected obligations are suspended. If a force majeure event continues for more than 60 days, either party may terminate these Terms upon written notice without liability.

Indemnification

You agree to indemnify, defend, and hold harmless BotSubscription, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your Content: Any content, products, services, or access you provide to your Subscribers through the Platform.
  • Your Marketing: Any advertising, promotional materials, or representations you make about your offerings.
  • End-User Disputes: Any disputes, refund requests, chargebacks, or complaints from your Subscribers.
  • Legal Compliance: Your failure to comply with applicable laws, including consumer protection laws, tax obligations, data protection regulations, or industry-specific regulations.
  • Third-Party Claims: Any claims by third parties that your use of the Platform infringes their intellectual property rights or violates their legal rights.
  • Your Breach: Any breach of these Terms of Service by you, your team members, or anyone accessing the Platform through your account.

This indemnification obligation survives the termination of your account and these Terms.

Indemnification Procedure: We will provide you with prompt notice of any claim subject to indemnification. You will have the right to assume the defense and control of such claim with counsel of your choice, provided that you may not settle any claim without our prior written consent unless the settlement unconditionally releases BotSubscription of all liability.

Right to Terminate

We may suspend or terminate your right to use our platform immediately upon written notice to you for any breach of these Terms of Service.

What suspension or termination includes: When we suspend or terminate your account, this includes disabling all associated services: your bot functionality, hosted checkout pages, API access, and any other Platform features tied to your account. We may take these actions individually or together, depending on the circumstances (e.g., disabling checkout pages for fraud while investigating, without fully terminating your account). We aim to suspend narrowly (e.g., checkout pages only rather than your entire account) and restore access quickly when issues are resolved.

Termination for Convenience: We may terminate your account without cause by providing at least 30 days' notice in accordance with the Notices section. In such cases, if you have prepaid fees on your account, we will refund a pro-rated portion covering the remainder of your subscription term. No refunds will be issued if your account is suspended or terminated for a violation of these Terms (e.g., fraud, AUP violations).

Effect of Suspension

During any period of suspension:

  • Bot functionality disabled: Your bot will not process new subscriptions, renewals, or payments. Existing Subscribers will lose access (or fail to gain access) to gated content.
  • Checkout pages offline: Any hosted checkout pages associated with your account will return an error or maintenance message.
  • API access revoked: API credentials and webhooks will be disabled; calls will return authentication errors.
  • Dashboard read-only: You may be able to view your dashboard and data, but cannot make changes or exports until the suspension is lifted.
  • Fees during suspension: Suspending your project does not void previously issued invoices or amounts due for the period your project was active. However, we will not charge platform fees for the period your project is suspended.

Reinstatement is subject to resolution of the issue that caused suspension and payment of any outstanding balances.

Important: Suspension disables our Platform's functionality, but your payment processor subscriptions may continue to bill independently unless you also cancel or pause them at the processor level (e.g., in your Stripe or PayPal dashboard). You are solely responsible for managing processor-side billing during suspension. You indemnify BotSubscription for any Subscriber claims arising from "charged while access was suspended" if the billing occurred at the processor level and was not caused by our breach.

Billing Continuity Checklist: Whenever your bot goes offline—whether due to suspension, termination, platform ban, your own decision to shut down, or technical issues—you must take action at your payment processor to prevent continued billing:

  • Pause or cancel active subscriptions in your Stripe, PayPal, or other processor dashboard.
  • Disable any recurring billing plans that would charge Subscribers for access they cannot receive.
  • Communicate with affected Subscribers about service interruption and refund options.

Failure to manage processor-side billing during service interruptions may result in chargebacks, disputes, and reputational harm for which BotSubscription bears no liability.

Community Standards & Conduct

Good Faith and Professionalism

We aim to build a trustworthy ecosystem. Users agree to address disputes directly with BotSubscription support in good faith.

We welcome honest feedback and constructive criticism—including public reviews, blog posts, or social media commentary. Your right to share your genuine experience with our Service is not restricted by these Terms.

However, you agree not to use the Platform or our community channels to:

  • Coordinate targeted harassment campaigns against our team or other users.
  • Spread demonstrably false information with malicious intent (e.g., fabricated claims designed to harm our reputation, not genuine complaints or opinions).
  • Abuse, threaten, or intimidate our support staff.

We reserve the right to suspend accounts that engage in such conduct. Disagreement with our policies, negative reviews, or escalating complaints through legitimate channels (e.g., payment processor disputes, regulatory bodies) do not constitute violations of this section.

This section applies to copyright claims (including DMCA notices) as well as trademark, patent, or other intellectual property claims. We handle all IP-related complaints using the same general process described below.

Submitting an IP Complaint

Designated contact: Send intellectual property complaints to our Legal Department at admin@botsubscription.com with the subject line "IP Complaint."

Required information: To process your complaint, please include:

  • Identification of the rights holder (your name or company).
  • A description of the copyrighted work, trademark, or other intellectual property you claim has been infringed.
  • The specific URL(s) or screenshot(s) showing the allegedly infringing material hosted on our Platform (e.g., on a checkout page).
  • A statement that you have a good faith belief that the use of the material is not authorized by the rights holder, its agent, or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on behalf of the rights holder.
  • Your physical or electronic signature.

We may not act on complaints that are incomplete, vague, or appear to be submitted in bad faith.

Content Hosting

Primary content: Your member content (e.g., videos, posts, community access) is hosted on third-party platforms such as Telegram, Discord, YouTube, or your own infrastructure. We have no ability to remove or modify content hosted on these platforms.

Checkout page content: We do host limited merchant-provided materials displayed on BotSubscription-hosted pages, such as plan names, descriptions, pricing, and images you upload for checkout pages. Upon receiving a valid IP complaint regarding this hosted content, we may remove or disable the allegedly infringing materials and notify you.

Our Role & Limitations

If we receive an IP complaint (e.g., a DMCA takedown notice) regarding content associated with your account:

  • We will forward the complaint to you in accordance with the Notices section.
  • For content we host (checkout page materials): We may remove or disable allegedly infringing content upon receiving a valid notice.
  • For content we do not host (your Telegram/Discord community, videos, etc.): We cannot delete this content. You must address the complaint directly with the relevant platform or the complaining party.
  • We reserve the right to disable checkout links, suspend bot functionality, or terminate accounts associated with content that is the subject of repeated, valid infringement claims.

Repeat Infringer Policy

In accordance with the DMCA and similar laws, we will terminate the accounts of users who are repeat infringers in appropriate circumstances. If you receive multiple valid copyright complaints that you fail to address or successfully counter, your account may be terminated.

Counter-Notification

If you believe a complaint was made in error or that you have authorization to use the material, you may submit a counter-notification. We will provide you with information on how to do so when forwarding a complaint. BotSubscription does not adjudicate copyright disputes. Unresolved disputes must be settled between the parties or through legal proceedings.

Confidentiality of Reports

If you report a bot or account for violating these Terms (e.g., fraud, IP infringement, policy violations), we may investigate at our discretion. To protect the privacy and security of all parties, we do not disclose the status, findings, or outcome of internal investigations to third parties. We are under no obligation to provide you with updates or explanations regarding our enforcement decisions.

Illegal Content & DSA Notices

Scope: This section applies only to content hosted directly on BotSubscription's infrastructure (e.g., checkout page text, images, or descriptions). We cannot act on content hosted on third-party platforms (Telegram channels, Discord servers, YouTube videos, etc.)—such content must be reported directly to the relevant platform.

If you believe any content hosted on our Platform is illegal in the European Union or violates our Acceptable Use Policy, you may report it to us.

DSA Contact Point: For the purposes of Articles 11 and 12 of the Digital Services Act (Regulation (EU) 2022/2065), our single point of contact for users, Member State authorities, and the European Commission is: admin@botsubscription.com. We accept communications in Bulgarian and English.

Reporting Mechanism: Send an email to admin@botsubscription.com with the subject line "Illegal Content Report." Your report should include:

  • A description of the content you believe is illegal or violates our policies
  • The URL(s) or screenshot(s) showing where the content appears on our Platform
  • An explanation of why you believe the content is illegal (including the relevant law or policy)
  • A statement confirming that you have a good-faith belief that the information and allegations contained in your report are accurate and complete
  • Your contact information for follow-up

Our Response: Upon receiving a complete report, we will acknowledge receipt and review the content in accordance with the Digital Services Act (DSA) and our internal policies. We will inform the reporting party of our decision without undue delay. We may remove or disable access to content we determine to be illegal or in violation of our policies.

Statement of Reasons: Where required by the Digital Services Act, when we restrict or remove hosted content, disable access to checkout pages, or suspend/terminate an account, we will provide a statement of reasons containing the information required by Article 17(3) DSA, including: (a) the facts and circumstances leading to our decision, (b) the legal or contractual grounds relied upon, (c) the scope of the restriction, (d) whether automated tools were used in the decision-making, and (e) available redress options. In urgent cases, this statement may be provided after the restriction is applied. We may withhold or delay specific elements of this statement only to the extent permitted by law and strictly necessary to avoid compromising an ongoing investigation or security measures. For restrictions not covered by the DSA, we will endeavor to provide a statement of reasons where practical.

Complaints & Internal Appeals: Where DSA Section 3 obligations apply to us as an online platform, we provide the internal complaint-handling and out-of-court dispute information described below. If you believe we have incorrectly restricted your content or account, you may submit an appeal by emailing admin@botsubscription.com with the subject line "Content Appeal" and including: (a) your account identifier or project name, (b) the restriction you are contesting, and (c) your reasons for believing the decision was incorrect, with any supporting evidence. We will handle complaints in a timely manner and issue a reasoned decision without undue delay, as required by applicable law. We aim (but do not guarantee) to acknowledge complaints within 5 business days. Possible outcomes include: reinstatement of content/account, partial reinstatement with modifications, or confirmation of the original decision with additional explanation. Where applicable under EU law (including the Digital Services Act), you may also have recourse to certified out-of-court dispute settlement bodies.

Limitations: As stated above, this reporting mechanism applies only to content hosted directly on BotSubscription's infrastructure.

Transparency Reporting: Where required by the Digital Services Act, we will publish transparency reporting information in accordance with our obligations. Current transparency reports (if any) are available upon request to admin@botsubscription.com.

Notices

This section governs how we deliver notices to you under these Terms. Where other sections require us to notify you, we will do so in accordance with this section unless otherwise specified.

Email strongly encouraged: We highly encourage you to provide and maintain a valid email address on your account. Email is our most reliable method for important notices. If you do not provide an email address, you accept the risk of missing critical notifications.

Notices from BotSubscription to you: For formal notices (e.g., termination, suspension, material changes to Terms, payment issues), we will attempt to reach you through all available channels: email (if provided), dashboard notification, and direct message via the platform you use (Telegram, Discord, etc.). We are not limited to one method—we will use all channels where and when possible to ensure you receive important communications.

Public channels for platform-wide changes: For changes affecting all users (such as sub-processor changes, major policy updates, or service deprecations), we may also post notices on our public channels (Discord announcements, Telegram announcements) in addition to individual notifications.

When notice is deemed received: If you have provided an email address, notice is deemed received 24 hours after sending to that address, whether or not you actually read it. If no email is on file, notice is deemed received 48 hours after we post a dashboard notification or send a platform message (Telegram/Discord DM), whichever occurs first. You acknowledge that platform messages may fail due to privacy settings, blocked DMs, or account status — providing an email address significantly reduces this risk.

Safeguard for irreversible actions: Before taking irreversible adverse action (account termination or data deletion), if email bounces and platform messages fail, we will make reasonable efforts to use any other contact method on file and/or delay the action by 7 days.

Notices from you to BotSubscription: The recommended method for all notices, inquiries, and formal communications is email to admin@botsubscription.com. You may also contact us through our community channels (Discord, Telegram) for general support, but email is preferred for any matter requiring a documented response.

Your responsibility: You are responsible for ensuring any contact information you provide remains current and that our messages are not blocked by spam filters or platform privacy settings. We are not liable for notices you fail to receive due to outdated contact information, platform settings that block our messages, or your choice not to provide an email address.

Terms for End-Users (Subscribers)

Subscribers purchasing through BotSubscription-powered checkout pages are governed by our dedicated Subscriber Terms of Use. That document is presented at checkout and constitutes the agreement between BotSubscription and Subscribers.

The following is a summary for reference. In the event of conflict, the dedicated Subscriber Terms control:

  1. Not a Seller: BotSubscription is not the seller of record. Your contract for goods and services is solely with the Bot Owner/Merchant.

  2. No Refunds from Us: We cannot issue refunds on behalf of Bot Owners. Contact the merchant directly.

  3. Fraud Reporting: Report suspected fraud to admin@botsubscription.com. We may investigate at our discretion but are not obligated to intervene in disputes.

  4. Release: To the maximum extent permitted by applicable law, Subscribers release BotSubscription from claims arising from the Bot Owner's content, products, services, or conduct. This does not limit mandatory consumer protections.

General Provisions

Assignment: BotSubscription may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, or sale of substantially all of our assets, without your consent. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

Severability & Mandatory Rights: Nothing in these Terms is intended to exclude or limit any rights you may have under applicable law that cannot be lawfully excluded or limited. If any provision of these Terms is held to be invalid, illegal, or unenforceable (including conflicts with mandatory consumer protection laws), the remaining provisions shall continue in full force and effect. The invalid provision shall be interpreted or modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

Entire Agreement: These Terms, together with our Privacy Policy and any applicable Data Processing Agreement, constitute the entire agreement between you and BotSubscription regarding the Platform and supersede all prior agreements, representations, and understandings.

No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by BotSubscription.

Survival: The following sections survive termination of these Terms: Relationship of Parties, Intellectual Property, User-Generated Content, Liability, Indemnification, Data Processing Addendum, Governing Law, and any other provisions that by their nature should survive.

Account Succession: In the event of an account holder's death or legal incapacity, we may transfer account access to a verified legal representative (e.g., executor, administrator, or power of attorney holder) upon receipt of valid legal documentation. We verify such requests at our discretion and are not liable for delays or refusals to transfer access if ownership is disputed or unclear.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Bulgaria. You irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

Language: These Terms are drafted in English. If we provide translations for convenience, the English version controls in the event of any conflict or ambiguity.
